Takedown Policy

At NFTiFay (“NFTiFay”, “we”, “our”, or “us”), we are committed to respecting intellectual property rights and maintaining a safe, transparent, and trustworthy NFT marketplace and related services (the “Platform”). This Takedown Policy describes how you can report content (including NFTs, metadata, images, names, descriptions, collections, profiles, or other associated materials) that you believe violates copyright, trademark, publicity rights, applicable laws, or our platform rules.

1. Grounds for Takedown

You may submit a takedown request if you believe that:

  • An NFT, its artwork, metadata, title, description, collection name, or related content infringes your intellectual property rights (including copyright, trademark, or publicity/personality rights);

  • The content is unlawful, fraudulent, misleading, offensive, or violates applicable laws or regulations;

  • The content violates our Terms of Service, Community Guidelines, or other Platform policies.

2. How to Submit a Takedown Request

To submit a takedown request, email us at [email protected] with the subject line: “Takedown Request”.

3. What to Include in Your Request (Required Information)

To help us process your request quickly, please include:

  1. Your full name (or company name) and your relationship to the rights (owner/authorized agent)

  2. Your contact details (email and, if possible, phone number)

  3. A clear description of the content you want removed (NFT name/collection, user/creator name, and direct URL(s) to the item(s))

  4. The specific IP right or legal basis you believe is being violated (copyright, trademark, publicity rights, etc.)

  5. Proof of ownership or authority (e.g., link to official site, registration number, original file/source, authorization letter if you are an agent)

  6. A statement that you have a good-faith belief that the use is not authorized by the rights holder, its agent, or the law

  7. A statement that the information in your notice is accurate and that you are the rights holder or authorized to act on their behalf

  8. Your physical or electronic signature (typing your full legal name is acceptable)

If any of the above information is missing, we may not be able to process your request.

4. Review and Actions We May Take

After receiving a complete request, we may:

  • Remove or disable access to the reported NFT/content;

  • Hide associated metadata/media previews;

  • Restrict user accounts that repeatedly violate rights or policies;

  • Request additional information if needed.

We may also preserve records related to the complaint for compliance, dispute handling, and security purposes.

5. Counter-Notification / Dispute (If You Believe Content Was Removed by Mistake)

If you believe your content was removed or disabled in error, you may submit a counter-notification to [email protected] with the subject line: “Counter-Notice”, including:

  • Identification of the removed content and its URL (if available);

  • A statement explaining why you believe the removal was mistaken;

  • Supporting evidence or context (e.g., license, permission, original work proof);

  • Your name, contact information, and signature.

Upon receiving a valid counter-notice, we may restore content if appropriate, or keep it disabled if required by law, platform policy, or ongoing dispute.

6. Repeat Infringers

NFTiFay may suspend or terminate accounts of users who are determined to be repeat infringers or who repeatedly submit unlawful content.

7. Misrepresentations

Submitting false or misleading takedown notices or counter-notices may result in legal consequences and/or account actions. We reserve the right to take appropriate measures where abuse of this process is detected.
