DMCA Policy

DLT Tech SHPK (“NFTiFay”, “we”, “our”, or “us”) respects the intellectual property rights of others and expects users of our NFT marketplace platform (the “Platform”) to do the same. It is our policy to respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (“DMCA”).

1. Notification of Alleged Infringement (DMCA Takedown Notice)

If you are a copyright owner or an authorized agent and believe that content on the Platform infringes your copyright, you may submit a written DMCA takedown notice to our designated contact.

Your notice must include:

  • A physical or electronic signature of the copyright owner or authorized agent;

  • Identification of the copyrighted work(s) claimed to have been infringed;

  • Identification of the allegedly infringing material, including the URL(s) and/or NFT identifier(s) sufficient for us to locate the material on the Platform;

  • Your contact information (name, address, telephone number, and email address);

  • A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law;

  • A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

2. Counter-Notification

If you believe your content was removed or disabled by mistake or misidentification, you may submit a written counter-notification.

Your counter-notice must include:

  • Your physical or electronic signature;

  • Identification of the material that has been removed or to which access has been disabled and the location where it appeared before removal (URL and/or NFT identifier);

  • A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification;

  • Your name, address, telephone number, and email address;

  • A statement that you consent to the jurisdiction of:

    • the Federal District Court for the judicial district in which your address is located (if you are in the United States); or

    • if your address is outside the United States, any judicial district in which we may be found,
      and that you will accept service of process from the person who provided the original DMCA notice (or an agent of such person).

We may forward your counter-notice to the party who submitted the original takedown request. If the original complainant does not file a lawsuit within the timeframe required by the DMCA, we may restore the removed content at our discretion and where appropriate.

3. Repeat Infringers

NFTiFay reserves the right to terminate, suspend, or restrict access to the Platform for users who are repeat infringers or whose content is repeatedly the subject of takedown notices.
